Highlights

A firm requested reconsideration of a decision dismissing as untimely its protest against the award of two contracts under a Navy request for proposals (RFP). In the original protest, GAO found that the protester had failed to file a timely protest despite its contention that it was only after it received a copy of a protest filed by another firm that it believed it had sufficient information to support its protest. GAO had further ruled that, since the protester did, in fact, have sufficient information to file a timely protest, its request for reconsideration did not fall within the good cause or significant issue exception to the timeliness rules. Accordingly, since the protester failed to show that the original decision was incorrect, the prior decision was affirmed.
