Highlights

A firm requested reconsideration of a decision holding that its low bid under an Air Force solicitation was nonresponsive because the firm did not furnish an acceptable bid bond surety. GAO had also: (1) rejected the protester's contention that the bids filed by the other firms were nonresponsive because their bid bonds did not have the required corporate seals, holding that the lack of seals did not affect the adequacy of the bid guarantee; and (2) declined to consider the protester's objection to the power of attorney forms executed by the other bidders' sureties, noting that it had not explained how the alleged defect affected the validity of the bid bonds. In its request for reconsideration, the protester raised questions about the small business size status of certain unnamed bidders and their alleged improprieties on certification and representations. GAO does not consider size status protests since that is under the authority of the Small Business Administration. The protester failed to produce new evidence or legal arguments showing that the original decision was erroneous. Accordingly, the prior decision was affirmed.
