Highlights

A firm requested reconsideration of a decision which dismissed its protest as untimely, contending that: (1) there was an incorrect address provided in the solicitation; (2) the individual signing for the solicitation was an employee of the contracting agency; and (3) its offer was received late due to government error and mishandling. The firm suggested that a waiver of bid protest procedures timeliness rules in its favor was a fair and reasonable request. GAO has held that it will only consider untimely protests when the issues raised are of widespread significance to the procurement community or that show good cause that some compelling reason beyond the protester's control prevented timely filing of the protest. GAO found that the protest did not fall within either exception to the timeliness requirements. Accordingly, the request for reconsideration was denied.
