A firm requested reconsideration of a decision which dismissed a protest of its exclusion from bidding on a Forest Service timber resale. GAO had found that the protester had defaulted on the previous contract because it had acquired and assumed the liabilities of the original contractor, and federal regulations permit the exclusion of a defaulting contractor. GAO found that the notice to bidders contained in the resale solicitation specifically provided that bids from the protester and its affiliates would not be considered. Therefore, the protester was not eligible to bid on the resale and was properly excluded from consideration. Accordingly, the prior decision was affirmed.
