A firm protested a contract award to another firm under a Veterans Administration solicitation for a dictation system, contending that: (1) a bid submitted by a firm that offered the protester's product was improperly rejected as nonresponsive; and (2) the awardee was the only manufacturer that could conform to the terms of the solicitation. GAO held that: (1) since the bid that offered the protester's product did not include all of the items required under the solicitation, it was properly rejected as nonresponsive; and (2) to the extent that the protest concerned the solicitation specifications, it was untimely filed because it was not received by GAO before bid opening. Accordingly, the protest was denied in part and dismissed in part.
