A firm protested a Defense Logistics Agency contract award, contesting the agency's determination that its low bid did not qualify for a waiver of a solicitation requirement. Bid protest procedures require that protests which are initially filed with a contracting agency be filed with GAO within 10 working days after the protester receives notice of the agency's adverse action. Since this protest was not filed within that timeframe, it was untimely and not for consideration. Accordingly, the protest was dismissed.
