[Protest of Air Force Contract Award Under Small Business Set-Aside]

A firm protested an Air Force award of a small business set-aside, contending that the awardee could not perform the required services and that the awardee subcontracted a major portion of the contract to a firm which was not a small business concern. GAO noted that whether a firm has the ability to perform a contract involves an affirmative determination of responsibility which is made by the contracting agency. Further, GAO will not review such determinations absent a showing of fraud or bad faith, which was absent in this case. GAO also does not review subcontractor selections because that is a matter of contract administration. Accordingly, the protest was dismissed.
