[Protest of Any Contract Award Under Army IFB]

A firm protested an Army contract award, contending that: (1) the low bidder was not responsive to the requirements; and (2) the procurement was tainted by bad faith. The protester also requested that any GAO ruling require an investigation to determine whether a conspiracy or other wrongdoing existed. GAO held that the protester's responsiveness argument actually referred to the awardee's responsibility which had already been confirmed by a Small Business Administration Certificate of Competency. GAO also held that: (1) the protester's bad faith argument arose out of a dispute between the protester and the awardee which is not covered by the bid protest function; and (2) it will not conduct investigations merely to establish the validity of a protester's assertions. Accordingly, the protest was denied.
