A firm protested a contract award to another firm under a Navy small business set-aside solicitation, contending that: (1) the Navy awarded the contract despite a determination by the Small Business Administration (SBA) that the awardee was other than small; and (2) the awardee lacked integrity and should not have been found responsible. GAO held that: (1) the Navy properly awarded the contract based on an initial determination that the awardee was small; (2) the Navy acted properly in awarding the contract notwithstanding the pendency of the protester's successful appeal to SBA; and (3) it does not review agency responsibility determinations absent circumstances not relevant to the instant protest. Accordingly, the protest was denied in part and dismissed in part.
