[Protest of DLA Contract Award Alleging Prejudice]

A firm protested a contract award under a Defense Personnel Support Center (DPSC) small business set-aside solicitation, contending that DPSC: (1) discriminated against the protester by failing to send it a copy of the solicitation, despite repeated requests; and (2) similarly discriminated against the protester in previous procurements. DPSC contended that the protester was included on a list of prospective bidders and that it sent the protester a second copy of the solicitation upon request. GAO held that: (1) the record indicated that DPSC did not deliberately attempt to exclude the protester from competition; (2) the validity of the award was not affected by the protester's exclusion from the procurement because adequate competition and a reasonable price were obtained; and (3) the protester's contentions regarding previous procurements were untimely filed. Accordingly, the protest was denied in part and dismissed in part.
