A firm protested a contract award to another firm under an Army solicitation, contending that: (1) the Army awarded the negotiated contract without discussions; and (2) a clause required by the Defense Acquisition Regulations was omitted from the solicitation. GAO held that: (1) under a negotiated procurement, a contract award may be made without discussions if adequate competition was obtained and the solicitation advised offerers of the possibility of award without discussions; and (2) the portion of the protest alleging that a required clause was omitted from the solicitation was untimely filed. Accordingly, the protest was denied in part and dismissed in part.
