A firm protested any contract award under a solicitation issued by the Department of Labor for film, contending that the product specified in the solicitation did not meet the Government's needs. Bid protest procedures require that a protest based upon alleged solicitation improprieties, which are apparent prior to bid opening, must be filed prior to that date. Because Labor reasonably believed that an envelope containing the protest contained a bid and did not open that envelope until the scheduled bid opening, the protest was untimely filed. Accordingly, the protest was dismissed.
