A GAO decision was requested as to whether sick leave, which a Forest Service employee bought back, could be retroactively substituted for leave without pay. GAO found that the employee went on sick leave pending a workers compensation determination; when the sick leave expired he went on leave without pay. When he was granted workers compensation, it was not sufficient to cover the entire period of his absence from work. The employee elected to buy back the sick leave he had used and made a timely request to retroactively substitute his bought back sick leave for the leave without pay. GAO had no objection to the retroactive recrediting of sick leave for the period the employee was on leave without pay, if the Forest Service determined that such an action was appropriate.
