[Protest of Requirement in DLA Solicitation]

A firm protested a procurement by the Defense General Supply Center (DGSC), contending that DGSC: (1) failed to prepare a solicitation that adequately defined its needs; (2) favored harnesses manufactured by another firm; and (3) followed improper procedures in evaluating a bid sample and refused to accept a second sample which the protester offered for testing. GAO held that: (1) the complaint concerning the solicitation specifications was untimely filed; (2) the complaint that the solicitation favored the competitor's product was untimely filed; and (3) the solicitation made no reference to bid samples and DGSC was not obligated to test the protester's sample. GAO noted that a blanket statement made by the protester agreeing to meet all of the Government's needs was not sufficient to demonstrate that its product was acceptable. Accordingly, the protest was denied in part and dismissed in part.
