GAO was asked whether a former Merit Systems Protection Board employee was entitled to have forfeited annual leave restored. The employee had timely requested the leave at the end of the 1982, but the request was denied by the employee's supervisor due to the office workload. At the beginning of the following year, the employee requested that the forfeited leave be restored. The Board denied the request, because the leave had not been officially scheduled in 1982. GAO has held that lost leave time may be restored only if the employee's timely request had been scheduled. GAO noted that, although administrative reasons may force an agency to deny an employee's leave request, the request itself must be scheduled. GAO held that the Board erred in failing to schedule the employee's request in 1982, regardless of the supervisor's intention to grant the time. Accordingly, the leave may be restored.
