A firm requested a review of a notice of overcharge issued by the General Services Administration (GSA) concerning the transportation of machine guns on two Government Bills of Lading. The claimant admitted to an overcharge but contended that it owed less than the amount claimed by GSA. GAO held that the dispute was the result of ambiguity in tenders written by the claimant and that such ambiguities are to be resolved against claimants. In addition, GAO held that an agency is entitled to the shipper's applicable tender which affords the Government the most favorable rate. Consequently, GAO sustained the GSA overcharge findings.
