GAO was asked for an advance decision regarding whether an employee who had been transferred may be reimbursed for a paving lien filed upon the sale of his residence by the city in which he resided. The claimant's basic argument was that he should be reimbursed for the paving lien, since he was required to pay it and it was customary for a seller in his city to satisfy such a lien prior to selling his house. GAO stated that capital improvements are analogous to operating and maintenance costs, which are not reimbursable under applicable regulations. Accordingly, the claimant may not be reimbursed for the cost of the paving lien on his house.
