GAO was requested to make an advance decision regarding the validity of a military pay claim submitted by a retired Air Force member for 1 day of active duty performed on the last day of a month. The record showed that the claimant had been on the temporary disability retired list, but was removed from the list after it was determined that he was physically fit for duty. The claimant was reappointed to the active duty list for 1 day to establish a basis for retirement for length of service. Under the monthly computation formula for military retired pay, the 31st day of a calendar month is ignored. GAO concluded that: 1) although the 1 day of duty fell on the 31st day of the month, applicable regulation entitled the claimant to active duty pay and allowances since the period in question was less than a month; (2) in addition to payment for the 1-day period of active duty, the claimant was entitled to full temporary disability retired pay for the remainder of the month, although military regulation requires that one day of the disability retired pay must be waived since the active duty was performed on the 31st day of the month. Accordingly, the claimant was entitled to disability retirement pay for the month in question minus 1 day's pay, and the payment of the voucher for active duty pay may be authorized if otherwise correct.
