An individual hired to haul gravel for road construction on Government land requested GAO assistance in connection with the contractor's refusal to pay him for labor and materials according to locally established hourly rates. The claimant also requested that GAO investigate the contractor's surety, which also refused to pay the claim. GAO stated that, in the event that a person is unable to collect amounts due for labor or supplies furnished under a Government contract, a suit may be brought under the Miller Act; however, the responsibility of GAO in such cases is limited to furnishing copies of act contracts and payment bonds when entitlement has been established by an affidavit.
