Highlights

A firm protested a Navy contract award on the grounds that the awardee lacked responsibility because it did not have the facilities or the financial capability to complete the contract. GAO held that it does not review protests concerning a contracting officer's affirmative determination of responsibility absent a showing that the contracting officer acted fraudulently or in bad faith or that definitive responsibility criteria had not been met. Accordingly, the protest was dismissed.
