[Protest on Issue of Low Bidder Responsibility]

A firm protested the anticipated award of a contract under an invitation for bids issued by the Naval Supply Center. According to the protester, the proposed awardee had not and could not comply with the applicable Defense Acquisition Regulation requirements. The protester further contended that the proposed awardee and its subcontractors would not be able to obtain the necessary operating authority and permits to comply with the applicable laws. GAO stated that both allegations were related to the bidder's responsibility, and GAO does not review affirmative determinations of responsibility except under limited circumstances, none of which were present here. Accordingly, the protest was dismissed.
