An individual requested reconsideration of a decision which dismissed as untimely a protest of award under a solicitation issued by the General Services Administration (GSA). The protest was filed with GAO only after GSA had twice denied its protest. GAO subsequently found the protest to be untimely under bid protest procedures. In the request for reconsideration, the protester contended that timeliness should have been measured from notice of the second GSA denial rather than from the initial denial. GAO found that: (1) nothing in the record constituted an offer on the part of GSA to reconsider its initial denial of the protest; and (2) even if GSA had been willing to further consider the protest, this did not toll the running of the period for filing a protest with GAO and, therefore, the protest was untimely. Accordingly, the prior decision was affirmed.
