A firm requested a decision in connection with an alleged violation of the Assignment of Claims Act. The firm contended that the Air Force incorrectly paid funds to the Internal Revenue Service instead of to the bank that was designated as the protester's assignee. However, the matter is presently before the Federal Bankruptcy Court in Kentucky. Arguments have been held but the court has not yet released the written text of its ruling. It is the policy of GAO not to decide issues which are before a court of competent jurisdiction unless the court requests, expects, or otherwise expresses an interest in a GAO decision on the matter. Therefore, it was not appropriate for GAO to interject itself into the ongoing litigation. Accordingly, the request was declined.
