A firm requested reconsideration of a previous decision which recommended that the Veterans Administration (VA) cancel a delivery order and issue a new request for quotations. This recommendation, made in response to a protest by another bidder, was based on a finding that the contracting officer failed to properly evaluate the bidder's low quotation. The firm also alleged deficiencies in that bidder's quotation. Bid protest procedures provide that a reconsideration of a decision may be requested by any interested party who submitted comments during the protest. The protesting firm in this case was advised of the original protest, was furnished copies of the VA report on it, and was afforded the opportunity to submit comments during the GAO consideration of the matter. However, the firm did not comment. Accordingly, GAO would not reconsider the decision. Regarding the allegation of deficiencies in the bidder's quotation, bid protest procedures require bid protests to be filed not later than 10 days after the basis of protest is known or should have been known. Since the firm did not file its protest within that timeframe, it was untimely and was not considered on the merits.
