A Federal employee requested reconsideration of a decision denying his claim for a retroactive temporary promotion and backpay. The employee's claim was based on an extended detail from a competitive service position to an excepted service position. In his request for reconsideration, the employee argued that his situation was comparable to that covered by the Turner-Caldwell decisions. In those decisions, GAO held that an employee detailed to a higher grade position for more than 120 days without Civil Service Commission approval is entitled to a retroactive temporary promotion and backpay beginning with the 121st day of detail. However, the Turner-Caldwell decisions apply only to those details covered under the provisions of the Federal Personnel Manual. Since the employee's detail was outside the scope of those details covered, there was no remedy available under the Turner-Caldwell decisions. Accordingly, the prior decision denying the employee's claim for a retroactive temporary promotion and backpay was sustained.
