Request for Reconsideration

Highlights

A firm requested reconsideration of a decision which denied its untimely bid rejection protest. To prevail on reconsideration, the protester must present evidence demonstrating error of fact or law in the original decision, or provide additional information not previously considered. In this case, the protester reiterated its basis for protest by arguing that GAO misunderstood the bases of its protest and reargued those points of contention. In addition, the protester requested a conference on the case. Protest procedures do not explicitly provide for conferences in connection with reconsiderations; GAO believes a request for a conference should be granted only where the matter cannot be resolved without a conference. It did not believe this was such a case. Since the protester did not present evidence demonstrating any error of fact or law in the original decision, nor provide any substantive information not previously considered, the previous decision was affirmed.
