An Army employee appealed the denial of his claim for four retroactive promotions and backpay. The record indicated that the employee had been temporarily promoted from grade GS-11 to GS-12 for four periods between 1974 and 1977. The employee claimed that he was detailed to a GS-12 position at all times during that period; however, the claim was denied on the basis of an Army report which indicated that he performed his GS-11 duties except during the four periods of temporary promotion to GS-12. Also, the employee failed to provide evidence that he was in fact detailed to the a higher-graded position for the entire time.On appeal, the employee submitted documentation furnished to him at the time of each temporary promotion, and claimed that the Army's justifications for the promotions, to provide "continuity of operations" and to correct inequities in his compensation, were evidence that he was performing the duties of grade GS-12 at all times during the period. GAO held that this information did not refute the Army's report which stated that the employee's duties reverted back to that of his GS-11 position at the end of each temporary promotion. Therefore, the previous denial of the claim was sustained.
