A firm requested reconsideration of an earlier decision in which its protest of the failure of the Army to solicit an offer from the protester in a procurement was denied. In its request for reconsideration, the protester reiterated its belief that the Army acted in bad faith and expressed concern that the decision, if allowed to stand, could be construed as condoning the exclusion of the protester from future procurements without a reasonable basis. GAO denied that the decision could be construed as condoning improper agency action since GAO held only that, based on the available record of the procurement, the exclusion of the protester in that particular case was not illegal. Since the protester did not establish any errors of fact or law in the original decision, there was no basis for reconsidering the decision.
