A firm protested against the use of a drawing in an invitation for bids issued by the Defense Logistics Agency. The protester insisted that the drawing was prepared and submitted to the Air Force on a restricted basis for a contract awarded to it in October 1975, that the contract was propriety to the protester, and that DLA was not authorized to publicly disseminate it for competitive procurement purposes. The protest filed with GAO more than 6 weeks after being filed with DLA was clearly untimely and not for consideration on the merits. The protest was dismissed.
