GAO was requested to comment on action wherein the plaintiff is seeking punitive damages based on being underpaid and suffering because of an error in his military record. The Claims Division denied this claim on the ground that it was not presented within 6 years of the date the claim first arose as required by law. GAO sustained this decision in its denial of the appeal. Subsequently, the plaintiff requested a review of that decision in a letter to the President and several letters to the GAO Office of General Counsel. The plaintiff was informed that the Office of General Counsel could not find a basis for further consideration of his claim. No record was found of a claim or demand which might furnish the basis for a cross action against the plaintiff.
