A company requested review of action by the General Services Administration (GSA) in collecting an alleged overcharge by deduction from freight charges otherwise due the carrier. The protester contended that its billing, based on the description in the original government bill of lading, was proper and that GSA failed to present sufficient evidence to prove that there was an overcharge for the shipment of platforms. The protester objected to reliance on statements by government administrative officers to resolve disputed questions of fact. The reliance of the protester on the description of the commodity on the bill of lading was misplaced. It was unclear from the face of the bill of lading exactly how the platforms were shipped and this ambiguity caused GSA to write to the administrative office. Based on records, the platforms shipped as described by the procuring agency were within the regulatory requirements and classification for assessment at the lower rating. Therefore, the deduction action against the carrier by GSA was proper.
