Claim of Supervisory Personnel to Additional Environmental Differential Pay

An advance decision was requested as to whether certain supervisory personnel, who were not members of an exclusive bargaining unit, could derive benefit from an arbitration award of additional environmental differential pay to nonsupervisory personnel who were within the unit. Since the supervisors were not covered under the negotiated agreement and since a previous action reducing differential rate did not constitute unjustified or unwarranted personnel action, they were not entitled to the additional differential awarded to nonsupervisory personnel.
