Request for Restoration of Forfeited Annual Leave

An advance decision was requested as to whether a Federal employee could be restored forfeited annual leave where such leave was scheduled pending the effective date of the employee's approved disability retirement. Forfeited annual leave may be restored where such leave was scheduled in advance, regardless of whether the leave was scheduled subsequent to approval of the employee's disability retirement. As the record indicated that the employee in question properly scheduled his annual leave, the agency could properly restore such leave.
