A National Guard technician appealed the disallowance of his claim for 132.5 hours compensatory time for temporary duty travel performed outside of regular duty hours during the period May 2, 1969, through August 1, 1974. The technician's claim was received on November 21, 1975; therefore, due to statutory limitations, that portion of his claim which accrued prior to November 21, 1969, was barred from consideration. The Civil Service Commission advised that while National Guard technicians are excluded from the overtime pay provisions of the Fair Labor Standards Act (FLSA), a technician who performs travel which is "hours of work" under FLSA is entitled to compensatory time. After May 1, 1974, the date of coverage of federal employees under FLSA, the claimant was entitled to compensatory time for travel time outside regular work hours if substantiated by the record.
