A protester contended that the award of a contract for the implementation and operation of a CHAMPUS fiscal intermediary system in Texas was not made in accordance with criteria set forth in the request for proposal (RFP). Investigation indicated that the source selection official's reliance on the offeror's claim to be a labor surplus area concern was improper since the Department of Labor (DOL) had removed the area from the list of such areas several months prior to evaluation and award. It is recommended that the contract be terminated and the award be made to the protester.
