A physician participating in an Armed Forces scholarship program received medical school assistance, including cost of tuition, books, and a monthly stipend in return for an active service obligation. Upon graduation he applied for and was granted a conscientious objector discharge before fulfilling any of his service obligation. The physician maintained that the only amount recoverable under the agreement he signed was the sum for tuition, books, and miscellaneous expenses. He offered a compromise settlement of the claim against him. As monthly stipend payments were included in the costs that he agreed to repay when he was accepted into the program if he did not fulfill his service commitment, the physician is indebted for the full amount of financial assistance he received. The compromise offer was rejected.
