Effect of Civil Service Reform Act of 1978 on Wage Agreements

A Deputy Assistant Secretary of the Department of Interior requested clarification of a GAO decision of February 3, 1978 which interpreted a subchapter of Section 9b, P.L. 92-392 as invalidating certain negotiated labor-management provisions relating to overtime. Subsequent passage of the Civil Service Reform Act of 1978 allowed prevailing rate employees whose contract provisions are covered by Section 9b to negotiate contracts without regard to restrictions in the subchapter. Accordingly, the GAO decision is overruled.
