Clarification was requested of a retired member's entitlement to pay and allowances for a period which included time in which he was in an "absence without leave/dropped from rolls as a deserter" status. The member who was in such a status was apprehended and returned to military control, ordered into a military hospital for treatment of a mental condition, and restored to the rolls. This action had the effect of restoring him to full duty status for pay purposes. He was not entitled to pay and allowances for the absence period since the absence was not excused as unavoidable. Since there was no court-martial conviction, the pay and allowances which accrued but were unpaid when the member entered the absence without leave status may be paid following his return to military control.
