Protest against Location of Government-Leased Space in Delineated Area

An individual protested the rejection of his bid to lease space as nonresponsive because the proposed location did not fall within the "delineated area" specified in the solicitation. The protest was untimely since it was filed more than 10 days after notice of adverse agency action. However, since the protester also filed suit in court and the court asked for GAO views, the protest was considered. The delineated area was arbitrarily drawn, and no valid reason was given for selecting the delineated area in such a way as to exclude the protester's site. The protest was sustained.
