An opinion was requested with regard to a settlement to cover a contractor's construction of a landing to remove timber from a national forest. The Government received a benefit from the construction even though the construction was not included in the original contract. The contractor should be paid for the changes on a quantum meruit basis and, in the future, a design change clause should be included in timber sales contracts.
