Restoration of Annual Leave Used in Lieu of Sick Leave

An advance decision was requested as to whether annual leave used by an employee in lieu of sick leave to avoid forfeiture may be restored. Since the employee never returned to duty after the injury, retired on disability, and there was no loss of annual leave, he may not retroactively substitute sick leave for the annual leave.
