An advance decision was requested as to whether the surviving dependent child of a deceased retired military member was entitled to a Survivor Benefit Plan (SBP) annuity if the widow was not receiving SBP benefits because her entitlement to Dependency and Indemnity Compensation was at least equal to the SBP entitlement. The widow's SBP annuity may succeed to the child because ineligibility for succession is based on remarriage prior to age 60, not on receipt of other benefits, but the child may not receive the annuity until the widow dies or remarries prior to age 60.
