An employee who was reassigned positions under a Merit Promotion Plan, with an informal agreement that he would be considered for promotions to higher positions after 6, 18, and 30 months, alleged that his grade classification was incorrect and claimed retroactive promotion and backpay. Since the granting of promotions is a matter of agency discretion and the employee did not have a vested right to be promoted at those intervals, he was not entitled to a retroactive promotion or backpay.
