Entitlement of Surviving Spouse to Survivor Benefit Plan Annuity

A decision was requested as to whether the annuity of a surviving spouse of a member who was covered by the survivor benefit plan must be reduced by the amount of Dependency and Indemnity Compensation (DIC) to which she was entitled as the result of a prior marriage. The annuity must be reduced by the amount of DIC entitlement even though DIC payment was predicated on the widow's prior marriage to another man.
