Agency Included Four Items in the Solicitation That Were Sole-Source Items

A company contended that the agency improperly included four items in the solicitation which were sole-source items to another firm. It claimed that these four items should not be awarded but negotiated sole-source with the only firm on the qualified products list and contended that the remaining items should be made to it based on its low "all or none" bid excluding the four sole-source items. The protest was untimely as it was not filed prior to bid opening. Any firm not on the qualified products list was restricted from bidding on an "all or none" basis while the firms on the qualified products list had this option. (SW)
