Request for Advance Decision Regarding Eligibility of a Potential Offeror

The Department of the Interior requested an advance decision on whether a proposal may be properly considered solely from the standpoint of the offeror's demonstration of compliance with the Buy Indian Act provisions of the solicitation. An otherwise eligible potential offeror could not obtain the certificate of tribal enrollment requested by the contracting agency because the Government did not timely process enrollment applications under its enrollment procedure. Since no other tribal enrollment procedure exists, the contracting agency should permit the offeror to present other information to establish compliance with the eligibility criterion.
