The claimant appealed the denial of his claim for payments alleged to be due under a lease executed with the U.S. Secretary of State for property in the Khmer Republic. The claimant failed or refused to collect rental checks tendered in foreign currency, as provided by the lease agreement, and the foreign currency later became valueless. The lessor was not entitled to be paid in dollars since the risk of currency devaluation was on the lessor. No officer or employee of the Government can modify a lease to favor another party unless some compensating benefit is received by the Government.
