The Administrator of the Office of Federal Procurement Policy, with the concurrence of the Department of Defense (DOD) and the Small Business Administration, requested an opinion on whether changes should be made in the small business and labor surplus area set-aside practices of DOD in light of recent legislation. The small business and labor surplus set-aside practices of DOD should not be changed to conform with section 502 of the Small Business Act amendments. Under the executive implementation of the Buy American Act, price differentials may be paid to achieve the required preferences for American products.
