The Veterans Administration requested advice concerning a protest filed with the agency in which a bidder on 14 of the 15 items solicited claimed that award to them on only the 14 items would more than offset the need for the fifteenth item. Since the invitation stated that the award for items 1-15 would be made in aggregate unless no bidder submitted a bid on all 15 items, and since award of a contract pursuant to advertising statutes must be on the same terms offerred to all bidders, award to the bidder on only 14 items was improper. Correction by entering a bid for the fifteenth item and displacing the low bidder would also be improper.
