The protester alleged that the agency's bias in evaluating their technical proposal was the sole cause of their omission from the competitive range. The protest was denied since there was no indication that the bias, even if it did exist, affected the protester's competitive standing. GAO will consider the merits of a protest after the protest has had a hearing in a United States District Court if the case has been dismissed without prejudice providing the protest was otherwise timely filed.
